Terms of business for our website and products

NAUTICAL SOFTWARE - TERMS & CONDITIONS

The following terms and conditions apply to all use of this website, and to any purchases of goods or services through this website. If you proceed with any purchase through the website, or on the basis of information on the website, you will be bound by these terms.

Copyright

All material, including text, graphics and source code are the copyright of LightMaster. Any unauthorised use of the materials on this site is strictly prohibited.

Software Packaging Disclaimer

Some software titles may be presented in a packaged carton on this website. This is purely for illustrative purposes, and software may be packaged in a different form. Any software supplied as a download might have no packaged version, or may omit some printed material which would be available when supplied in a package.

Fitness for Purpose

It is the nature of software, and the wide variety of hardware and software configurations in different computers, that it is not possible to provide absolute guarantee of performance in any particular situation. We will make our best endeavours to provide software which gives satisfactory performance, but we do not warrant that any of our software products is fit for any, or any particular purpose.

Licensing

As is common practice with computer software, all rights to the program are retained by the developers and any "purchase" of software is the grant of a non-exclusive right to install and run the software on a particular machine, within the specific terms of that licence. Personal Licences permit installation on more than one PC, but only for exclusive use by the same one individual for personal study. Professional Licences each permit installation on only one machine. Additional machines require more licences, or a Site Licence.

Transfer of Licence

Personal Licences are non-transferrable. They are issued for the sole use of one named individual in perpetuity. Professional Licences are only transferrable with specific written consent from LightMaster.

Returns

You may return software, even if it has been correctly supplied in accordance with your order, within 7 days, provided that the packaging is unopened and it has not been loaded onto any PC, or copied or retained in any form.. Any physical medium, such as a CD, which is delivered to a customer in a damaged condition will be replaced without charge. If you wish to return any product, other than as above, you must obtain the prior consent of LightMaster/NauticalSoftware. If your request is granted, you will be advised of a returns reference, which must be quoted in the returned package before any refund can be considered.

Website Availability and Accuracy

We shall use our best endeavours to provide uninterrupted access to this website. It is hosted at a commercial hosting company and occasionally may be subject to problems beyond our control. Inevitably there will be some periods of non-availability when maintenance or updates are required. We can give no guarantee of availability of any promised downloads at any specific time, but outages should be rare.

We hope to keep all information correct and updated at all times, but cannot be held liable for any errors: under no circumstances will we be liable for any costs beyond the refund of the purchase price paid to us.

Disputes

In the event of any dispute, you must make your complaint to LightMaster Software in writing, to the address on the Contact page. If it is not possible to resolve the dispute by negotiation, the matter shall be determined under the laws of England and Wales.
